“In custody cases, mental health records are relevant but not fully discoverable. Courts typically protect psychotherapy notes due to their private nature and only allow limited disclosure with safeguards.
“Disclosing these notes can harm privacy, therapy, and discourage treatment, so courts should only order disclosure when absolutely necessary.”
